It is often the lament of lawyers working in the criminal jurisdiction that one of the hardest parts about their jobs is dealing with the lies police constantly come up with, often whilst giving evidence under oath.  Evidence they release via the disclosure process is selective and often not a true reflection of the contextual facts.  To describe the police in this country as professional perjurers is not as far fetched as it may seem at first blush.

Government and indeed the police themselves would have the public believe that they are held to account by the Independent Police Complaints Authority and their own internal disciplinary procedures.  The “Independent” part of the IPCA’s name is about as farcical as the belief that our police are honest upright individuals who can do no wrong.  Hardly a week passes when some adverse publicity about the activities of some wayward police officer does not surface.

In reality almost all but a small percentage of complaints to the IPCA are “investigated” by the police themselves and their agenda is always blatantly clear.  That being to protect their own even if this is achieved at the expense of manipulating witnesses and the evidence to paint a picture that suits their ends.

Testimony to this philosophy is that most police treat complaints as an occupational hazard and it is often with pride that some individuals boast about the number of complaints they have had made against them.

All one need do is take a cursory look at the history of some of those who are now in senior management positions within police and it becomes clear that those attitudes and cultures that have helped them claw their way up the ranks are alive and well today.

A typical but my no means isolated example of this is Detective Inspector Mike Oxnam the head of Kapi Mana CIB.  In his younger days Oxnam was not adverse to using his size and bullying tactics to achieve his own ends and there are stories of him beating a prisoner around the head with a telephone book until that hapless individual’s ears bled.  Those who have known Oxnam over decades observe that he was a bully and thug at school and thus the police was a perfect career choice for him.

Now that Oxnam and many others like him have reached senior ranks their tactics and methodology may have changed but the same attitudes and propensity for perjury remain just as dominant.

It is not all that long ago that Oxnam stated to a member of the public that he did not care what laws or rules his staff broke just as long as they got results.  Speaking about one of his then subordinates, Detective Stu Taylforth, he went on to say that he knew Taylforth had told a few lies and broken some rules but that was of no consequence to him because he managed to arrest people. Another of Oxnam’s staff was criticized by a judge when that detective was giving evidence in the Porirua District Court.  The presiding judge told this detective that he did not believe anything he had said.  Police management took no action whatsoever against the detective involved and no doubt he continues lying in the same fashion, secure in the knowledge that his masters support such behaviour.

The country’s police stations are littered with this attitude and as Government continue to give police increasing powers the public need to be alarmed and take a stand.  With the elections looming this is the time to start asking your politicians the hard questions.

When is Superintendent Sam Hoyle going to get his district under control?  We do not even have to dig to find out the extent of the corruption that exists within the Hawke’s Bay police ranks, they just keep on falling in to our laps!

With such a serious and systemic dishonesty problem in his district you would think that Hoyle would be concerned, as the public could expect of any responsible and honest manager.  But not so, Hoyle turns a blind eye to such behavior and likely even encourages it in the hope that it will make his statistics look good and enhance his obsessive ambition for promotion.

Initiative has previously outed Napier’s Sgt Kristina Eckhold for lying in a police job sheet after she served a trespass notice; an exercise solely designed to hinder the proper administration of the law.  Now her colleague and serial bully Daryl Moore has been caught out lying to protect Eckhold.  Just as well Kristina is married to NZ Police Association vice president Luke Shadbolt because if she keeps going the way she is, she will soon find herself in need of the Police Association’s advocacy to help her keep her job.

Recently Moore responded to a request for information, and here we quote the relevant paragraph from his 5 December 2013 letter on police letterhead and signed by Moore:

Police do not have a Police policy circular that deals with trespass.  Your request is refused pursuant to section 18(e) of the Official Information Act as the information does not exist.”

How stupid or arrogant or both is this guy that he thinks he can get away with such blatant dishonesty?  Upon receiving Moore’s letter it was obvious that this was but one of a number of factual deficiencies and so further enquiries were mase.  A request for the same information was made to Police National Headquarters and in a rare display of efficiency, within a matter of hours a copy of the trespass policy that Moore purported not to exist was provided.  So Dudley you have been caught out lying…….yet again.

Here again we have a police officer who, like Eckhold, is in a supervisory role and should be setting an example and standard of integrity for his staff.  Or more likely this is the standard that police aspire to and encourage?  All these concerns have previously been put to Hoyle but he has gone to ground and has no response to offer.

No doubt the incidents reported on this web site are only a small representation of the lie, deny and perjure culture and there are plenty more examples out there.  Initiative will continue to expose police corruption and lies without fear or favour.

Just days after giving expert evidence against police during a civil trial in Auckland,  a Hawke’s Bay man’s home was raided by out of control police under the leadership of Daryl Moore.

This same man has civil proceedings against police and it is not that long ago that police served him with a trespass notice designed solely to prevent him from properly serving legal documents on police.

This most recent example of how out of control was a not so carefully crafted attempt at harassment and intimidation designed to detract attention from the police’s own lie, deny and perjure culture which has so frequently been exposed in the media on an almost daily basis.

Proffering what will most likely prove to be a bogus search warrant Moore and his henchmen seized external hard drives and basically invaded this man’s private home for no reason other than to satisfy their hunger for revenge.  Police had previously seized the man’s computers and refused to return them until directed to by a Judge in civil proceedings brought by the man.  During the lunch adjournment at that hearing Moore was caught hiding around the corner in the courthouse attempting to eves drop on a conversation between the man and his lawyer.  In isolation this would be something that could be brushed off as trivial but as part of the overview it demonstrates the devious and divisive nature of police.

We can only but speculate how long it will be before they return with another search warrant looking for these recordings.  Despite a facade or bravado these bullies were not happy about being made accountable and Moore in particular had some difficulty containing his anger, occasionally loosing his composure.

Moore purports to be the resident computer expert for Hawke’s Bay police and we are told has been known to boast in childish fashion that he has an internet connection coming in to his office that bypasses the usual police firewalls and access restrictions.  One can only but speculate what he gets up to on that connection or why he would need this.  For one who purports to be a computer expert he was having a hard time distinguishing between a thin client and a hard drive, but I guess you don’t have to be a computer genius to stand up in court and lie.

All three police were trespassed from the property but promised to come back.  They left without any arrests being made and without providing a receipt for property taken.

Superintendent Sam Hoyle has a great deal to answer for, as we keep seeing example after example of just how out of control his staff are. In what is becoming an alarming series of revelations about just how out of control the cops are in Hawke’s Bay, Initiative has been made aware of a further example of just how arrogant and beyond the law the police culture is in that area.

A Napier grandmother has managed to fall foul of the local law and based on their track record, in Hawke’s Bay you don’t even have to break the law to get charged with something.  Selective policing is a problem throughout the country but even more so in this area where the police culture of lie, deny and perjure is paramount to the point of obsession.

The grandmother, who has no convictions and was previously ignorant of the vindictive nature of police, has been hit with a curfew as part of her bail conditions whilst waiting for the opportunity to defend herself at a hearing.

It seems that the cops in Napier must get bored on night shift and then get their kicks by depriving people of sleep.  The women claims it has not been uncommon for them to come knocking three times a night.  Police claim not to have retained records going back further than a months, but those reveal that there were 37 bail checks in 30 days.  A more complete set of records would show police pettiness in an even worse light.

Acting on advice and desperate for sleep this woman began asking police to identify themselves before she would open the door in the middle of the night.  This resulted in  oral abuse for all the neighborhood to hear.

Upon being photographed, as is any householder’s right, and Constable Natasha Caccioppoli and Constable David Power then tried to seize the camera.

Since being threatened by the householder with having their photos published police have not returned!

Initiative condemns the dishonest and bullying actions of these officers, who claim to be “just doing our jobs”.

If you are experiencing similar harassment Initiative recommends you adopt the same tactics:

1     Do not open your door to police until they have identified themselves and if you are in any doubt call 111 to verify that identity BEFORE opening the door.

2    Photograph police every time they come to your door or on to your property and keep good written records of each visit, including the identity of each cop.

3     Try to keep your cool as it is a common police tactic to try and push people in to becoming angry and abusive so they can use this as an excuse to arrest them.

Superintendent Sam Hoyle reached an all-time low in childish behaviour by serving a trespass notice on a Hawke’s Bay man who is in the process of bringing civil proceedings against police.  That document effectively prevents him from serving documents on police in the course of properly brought legal proceedings.

Here is yet another abuse of police powers in Hawke’s Bay that is sanctioned from the man at the top himself.Holye is clearly unhappy that his carefully crafted  image  is dented when faced with court proceedings that could ultimately demonstrate just how inept a manager he really is.

It is not all that long ago that as a young police officer Hoyle was spending his days tearing up and down the beaches of Northland in a police vehicle under the guise of respectable policing, we are told it was actually nothing more than a boy racer mentality and later boasting to family and friends about his activities.

Even more recently he left Wanganui where he was Area Commander, after indulging himself in an affair that was the ultimate betrayal of both wife and family.  In what is perhaps an interesting coincidence, Tania Kura spent part of her career in Wanganui.  We can only but speculate on why she ended up working under Hoyle in Hawke’s Bay.

Numerous attempts have been made to contact Sam Hoyle who would not respond to emails or phone calls so we turned to Police Commissioner Marshall for comment but still nothing.

It would seem police are remaining tight lipped about Hoyle’s dummy spitting or their attempts to obstruct justice by way of making it difficult for a man to serve legal documents on police because quite simply they have no justification for those games.

Senior Constable Damion Horricks of the Waipukurau Police gives us an example of this sort of smoke and mirrors behaviour.

One would expect that having reached the lofty rank of senior constable, Horricks would be well versed in the law that he deals with every working day.  But perhaps the reality of that rank is that he has survived ten years in the job without being done for perjury.

When this photo was taken of him Horricks tried to tell the occupier and photographer that because he was on private property permission was needed (from Horricks) before he could be photographed.  It seems that Horricks was arrogant and ignorant enough to expect that he would be believed just because he was a police officer quoting what he purported to be the law.  After the event Damon Horricks was given the opportunity to support that brash statement by citing the legislation he was relying upon, but had no comment to make.

So here we have yet another police officer caught out lying.  In what is a typical example of the attitude of dishonesty that dominates the police culture in New Zealand, Horricks is just another professional liar, a trait he will no doubt take in to the Courtroom.

In September 2012 a team of police from Waipukurau executed an illegally obtained search warrant on a home in rural Waipukurau.  Police are usually quick to distance themselves from any civil matters but it seem that when it suits their double standards they will make an exception and in this instance they jumped straight in to something that was a civil matter.

The OIC of that operation was Senior Constable Mike Dalby, a country cop who is effectively guilty of home invasion.  When lawyers tried to complain to police in November 2012, Area Commander Sam Hoyle absolved himself of all responsibility and passed it on to his underling Tania Kura to be dealt with.  Instead of responding in a transparent and honest manner Kura went to ground and refused to engage with lawyers in any way, no doubt hoping that this would make the problem go away.  For months Kura and her staff refused to pass the complaint on to the Independent Police Conduct Authority, in arrogant defiance of the legislation which specifically requires police to notify the IPCA within 5 working days.

Solely because of Kura’s inability to deal with and front up to their failures police now face civil proceedings.  Even when confronted with this they continue to waste huge amounts of tax payer money by employing cash strapped high priced Crown lawyers to defend the indefensible.

You might well ask what’s going on with policing in the Hawke’s Bay, since district commander Inspector Tania Kura took over control of the patch.  Kura came to Hawke’s Bay from what police spin doctors describe as a “senior role” at the Police College.

Kura and her partner Inspector Dave Archibald ended up at the Police College after Archibald was caught passing information from the police national computer whilst stationed in Tauranga.  In what has so frequently proved to be typical of the New Zealand police force, if you get caught or screw up you get promoted.

Hawke’s Bay has long held a reputation for having a police force more out of control than the rest of the country.  Since her arrival last year Kura has worked hard to maintain that reputation and indeed conspired to perpetuate acts that support the culture of lie, deny and perjure.

Despite her efforts to cover up the corruption within her patch it has failed to gain her the support of her staff with Hawke’s Bay with more than 20 officers having left since the Napier and Hastings areas merged into one Hawke’s Bay unit under Kura in August last year.  Many of those who left, disclosing to media sources Kura’s “my way or the highway” approach to people management.

Despite scathing public criticism from both current and former staff Kura is quoted in media reports as saying she is “not concerned”.  This astonishing response personifies the arrogance and ignorance that prevails within police management.  Kura should be concerned.  After only a year in the job she has failed to impress either her own kind or the public.  There have been a number of spectacular failures under Kura’s short reign of power and control.

Otaki community constable Terry Moore has been ripping the system off for years and police have been turning a blind eye to his dishonesty.

Moore first came to the Kapiti Coast from Blenheim to take up the role of Iwi Liaison office for police.  Whilst living and working as a detective in Blenheim Moor and his family lived in subsidised housing on Woodbourne Air Force Base.  In this job he was one of the privileged few who still got to take a company car home.  It was during this time that Moore quickly gained a reputation amongst his colleagues for being the invisible man, because he was never where he was supposed to be.

Frequently during working hours Moore was spotted in Levin, often towing a trailer load of building materials behind his unmarked police vehicle.  Initiative is aware that Moore owns rental properties in Levin and much of the restoration and maintenance work on those properties was carried out whilst he was being paid to be at work.

In a move typically double standard, police turned a blind eye to Moore’s deceit and returned him to the brotherhood.  Not only that but they put the now separated Moore in to a police house in Otaki at peppercorn rental.

Whilst working at Levin and owning properties in that town, Moore was enjoying the benefits of tax payer subsidised housing a few kilometres down the road in Otaki.

To this day Moore enjoys the perk of living in a police house whilst getting income from rental properties just up the road.  Nice work if you can get it.  The frightening thing is that Moore seems to think this sort of behavior is quite acceptable and he is doing nothing wrong.  Such attitudes are typical of the police culture and double standards.

Otaki is an area that has typically been hard to staff and the sort of police officers who end up there have fallen from grace elsewhere in the country.  Moore’s tenure there is testament to this and the fact that police management are not only aware but turn a blind eye to such blatant ripping off of the system, is testament to the police culture of lie, deny and perjure.

Setting aside the questionable ethics of Senior Constable Terry Moore, in how many towns around the country is this blatant dishonesty repeated?  When questioned by opposition politicians, the former Minister of Police denied all knowledge and suggested that it was a matter for the Commissioner.  Yet when opposition politicians wrote to the Police Commissioner the response was to lie and deny.

In the wake of blistering media criticisim of Napier/Hastings district commander Inspector Tania Kura, her boss Eastland District Commander Superintendent Sam Hoyle is looking to jump ship.

Just days later Kura’s boss and mentor Superintendent Sam Hoyle is looking to quit town.  This week Hoyle is in Wellington interviewing for a new job as Wellington District Commander.

When you look at history and see how police reward their under-performing or wayward staff, there is a good chance Hoyle may soon be packing his bags and moving closer to the bosom of Commissioner Peter Marshall.

So with Hoyle joining those leaving in droves let’s just hope for the sake of the people of Hawke’s Bay that they do not promote Kura to Hoyle’s old job.

Superintendent Hoyle declined to comment when invited to do so.
